Last updated: 20/10/2025
OVERVIEW
Welcome to Thomby! The terms “we”, “us” and “our” refer to Thomby Technology Limited (“Thomby”).
Thomby operates this website and online store, including all related information, content, features, tools, products and services (together, the “Services”), to provide you with a curated shopping experience.
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) explain your rights and responsibilities when using the Services.
By visiting or purchasing from our store, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
Nothing in these Terms affects your statutory rights under UK consumer law.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years old (or the age of majority in your country of residence).
You agree that all information you provide is true, accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
SECTION 2 – OUR PRODUCTS
We make every effort to display our products accurately. However, images and colours may vary depending on your device and settings.
Descriptions and prices are subject to change at any time without notice. We may limit or discontinue products at our discretion.
Nothing in this section affects your rights under the Consumer Rights Act 2015 – goods must be as described, of satisfactory quality, and fit for purpose.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase the selected goods. Your order is accepted only when we send an order confirmation email.
If we cannot accept your order, we will notify you and refund any payment taken.
By placing an order, you confirm that you are purchasing for personal use and not for resale.
Your order is subject to our Refund & Returns Policy, which forms part of these Terms.
SECTION 4 – PRICES AND PAYMENT
All prices shown are in GBP (£) and include VAT. Delivery charges and any other costs will be shown before you confirm your order.
Prices may change from time to time but will not affect orders we have already accepted.
You agree to provide current, complete and accurate payment information. By submitting payment details, you confirm that you are authorised to use the chosen payment method.
SECTION 5 – DELIVERY AND RISK
We deliver to UK addresses (and other regions where specified). Delivery times are estimates only, but unless otherwise agreed, we will deliver within 30 days of accepting your order.
Risk in the goods passes to you once you (or someone nominated by you) physically receive the goods. Until then, we remain responsible for them.
If delivery is delayed for reasons beyond our control (e.g., courier strikes, extreme weather), we will inform you as soon as possible and take reasonable steps to minimise delay.
SECTION 6 – YOUR RIGHT TO CANCEL
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order for most goods within 14 days after you receive them.
To cancel, contact us at hello@thomby.co.uk with your order details.
If you cancel within this period:
-
You must return the goods within 14 days of notifying us.
-
We will refund the full amount you paid, including standard delivery costs, within 14 days of receiving the goods back (or proof that you’ve sent them).
-
You are responsible for return postage costs unless the goods are faulty, damaged or not as described.
Your statutory rights to a refund or replacement for faulty goods remain unaffected.
